Sole Source Justification

 INSTRUCTIONS FOR ETHICS FORMS AND RESOLUTIONS

 ETHICS FORMS

  1. Ethics Forms 1, 5, 6 and 7 (if applicable) must be signed by the same person who executes the Contract, Amendment or Letter Agreement.
  2. All Ethics Forms must be signed and dated the same date as the Contract, Amendment or Letter Agreement.
  3. Ethics Forms 1 and 5 must be notarized by a notary public.

RESOLUTIONS

  1. Resolution for Signature Authority
    • A Certified Resolution must be signed by an officer other than the individual signing the contract and executed the same date of the contract or later. If later, the resolution must include the statement “such resolution has not been modified, rescinded or revoked, and is, at present, in full force and effect.”
    • The date the resolution is adopted must be on or before the date the contract is signed.
  2. Nondiscrimination Certification
    • By law, a contractor must provide the State with a Nondiscrimination Certification.
    • No changes can be made to the format of the resolution statement.
    • The date the resolution is adopted must be on or before the date the contract is signed, but after June 25, 2007 (the date the Nondiscrimination Certification requirement became effective).
    • The Nondiscrimination Certification must be signed the date of the contract or later. If later, the resolution must include the statement “such resolution has not been modified, rescinded or revoked, and is, at present, in full force and effect.”
